Microgreens Subscriptions - Terms of Service

Delivery
Woodstock Microgreens LLC provides a home delivery service that is available in limited areas.
Please carefully review the following waiver of liability. This document outlines the health and legal risks associated with consuming raw, unwashed microgreens provided by Woodstock Microgreens LLC through the Microgreens Subscriptions service. By subscribing to our service, you acknowledge and agree to the terms and conditions set forth below.
1. Assumption of Risks:
2. You understand that the microgreens provided through our service are raw agricultural products and are not washed or sanitized. Consuming unwashed microgreens involves inherent risks, including but not limited to the risk of illness, injury, or death. You voluntarily assume all risks associated with the consumption of our microgreens and understand that you must sanitize them before consumption.
3. Health Risks:
4. a. Contamination: Despite our best efforts to maintain a safe and clean growing environment, there is a risk of microbial contamination in any agricultural product, including microgreens. It is your responsibility to sanitize the microgreens before consuming them. Consuming raw, unwashed microgreens may lead to illness or other health complications. Woodstock Microgreens LLC is not responsible for any health issues arising from the consumption of our microgreens.
5. Legal Risks:

Compliance: It is your responsibility to ensure compliance with all applicable laws and regulations regarding the purchase, possession, and consumption of raw agricultural products, including microgreens. Woodstock Microgreens LLC does not assume any liability for non-compliance with local, state, or federal laws.
7. b. Indemnification: You agree to indemnify and hold harmless Woodstock Microgreens LLC, its owners, employees, and affiliates, from any claims, damages, liabilities, or expenses arising out of or in connection with your consumption of our microgreens or any violation of these terms.
8. Release and Waiver:

You hereby release and discharge Woodstock Microgreens LLC, its owners, employees, and affiliates from any and all claims, liabilities, actions, or causes of action arising out of or related to the consumption of our microgreens. This release includes, but is not limited to, claims for negligence, product liability, breach of warranty, or any other cause of action, whether known or unknown, arising out of your subscription to the Microgreens Subscriptions service.
10. Governing Law and Jurisdiction:
11. These terms shall be governed by and construed in accordance with the laws of the state or country where Woodstock Microgreens LLC is based. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
By subscribing to the Microgreens Subscriptions service provided by Woodstock Microgreens LLC, you acknowledge that you have read, understood, and agreed to the above waiver of liability. You understand that the microgreens provided are raw agricultural products and must be washed and sanitized before consumption. If you do not agree with any part of this waiver, please refrain from subscribing to our service.
Payment
Subscribers will be charged in advance based on their subscription plan, which can be weekly or biweekly. All subscriptions with valid payment methods will renew automatically. Payment is due and will be charged at the beginning of each billing cycle unless canceled.
If you subscribed at the end of the month and the following month lacks the corresponding date (e.g., the 31st), the preceding date will be selected (e.g., the 30th). The renewal date will revert to the original date in the subsequent month if it exists.
Example: If a customer has signed up for a subscription that renews on the 31st of every month, the renewal will occur on January 31, February 28, March 31, April 30, and so on.
Duplicate Subscriptions
Please ensure that you maintain only ONE SUBSCRIPTION ACCOUNT with us. To receive a full refund for any duplicate account, you must notify us within 30 days of opening that duplicate account. After 30 days, we can only offer credit to your remaining active account. Thank you for your cooperation.
If we do not hear from you, we will assume that you wish to keep ALL accounts active. To check for duplicate accounts, please review your credit card statement for any charges from Woodstock Microgreens. If you receive more than one charge per week, it is likely that you have more than one account.
Cancellation
Subscriptions can be canceled at any time. Cancellation requests must be received before the start of the next billing cycle. Failure to request cancellation before the beginning of the next billing cycle will result in being charged for the subsequent billing cycle, and the cancellation will take effect at the end of that cycle.
In most cases, subscriptions are canceled at the end of the term, with service and product deliveries continuing until the end of the term unless an immediate cancellation is requested. Upon canceling a subscription, you will not be charged for future subscription payments, and past subscription payments will not be refunded.
Canceling during the trial period will immediately terminate the subscription and delivery.
All payments are non-refundable. Woodstock Microgreens reserves the right to interpret the terms and conditions. In rare and exceptional cases, a prorated payment may be issued upon review by the owner.
Refunds
All purchases are considered final, and Woodstock Microgreens has a no refund policy. Refunds may be considered on a case-by-case basis at the discretion of Woodstock Microgreens for special cases and promotions.
Missing deliveries or other delivery issues do not warrant changes to the cancellation terms or qualify for a refund. However, Woodstock Microgreens will extend subscriptions to compensate for any missing products.
Purchased microgreens will continue to be delivered throughout the remainder of the current subscription unless a request is made to discontinue the deliveries.
Customer Service
For training purposes, any phone communications between you and Woodstock Microgreens staff may be recorded. Additionally, any subsequent communication between you and any Woodstock Microgreens staff, regardless of form, may be used for training purposes.
By providing your email and phone number, you have automatically opted in to receive marketing and customer service calls, emails, and texts. You can choose to opt-out of these notifications at any time.
We reserve the right to make changes to our products and this policy at any time.
